Terms of Service

Welcome to form8n. These Terms of Service ("Terms") form a binding agreement between you and form8n ("form8n", "we", "us") and govern your use of our websites, applications, marketplace, and services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms.

1. The Service

form8n is a platform that helps founders form, brand, launch, and operate a business — including site building, content tooling, product staging, marketplace listing, and payment facilitation. Features may change as we improve the product.

2. Accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
• You are responsible for keeping your credentials secret and for all activity on your account.
• You agree to provide accurate information and to keep it up to date.

3. Your Content

You retain ownership of the brand assets, product information, images, and copy you create or upload ("Your Content"). You grant form8n a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content solely to operate and improve the Service, including displaying it on your published storefront and in the marketplace.

You represent that you have the rights to Your Content and that it does not infringe any third-party rights or violate any law.

4. Acceptable Use

You agree to follow our Acceptable Use Policy. We may suspend or terminate access for violations, including listing prohibited goods, abusing AI features, scraping, or fraudulent payment activity.

5. Marketplace & Storefronts

The marketplace is a hosted environment for founder-owned brands. form8n is not the seller of items listed by founders. Each founder is the merchant of record for their goods or services unless explicitly stated otherwise. Buyers transact with the founder; founders are responsible for fulfillment, customer service, returns, tax, and compliance.

6. Payments

Payment processing is provided by Stripe. By using payments features you also agree to Stripe's Connected Account Agreement and Services Agreement. form8n may charge a platform fee on transactions, which is disclosed in your payments settings. You authorize form8n to deduct the platform fee from your payouts.

7. AI Features

The Service uses AI models to help generate names, copy, imagery, and other content. AI output may be inaccurate or offensive — you are responsible for reviewing it before use. You must not use the Service to generate unlawful content, deepfakes of real people without consent, or content that violates third-party rights.

8. Fees & Credits

Some features consume AI credits or carry subscription fees. Pricing is shown in-product. Fees are non-refundable except where required by law. We may change pricing on prospective notice.

9. Intellectual Property

The Service, including its software, design, and trademarks, is owned by form8n or its licensors. Except for the rights expressly granted to you in these Terms, all rights are reserved.

10. Termination

You may close your account at any time. We may suspend or terminate your account for material breach, suspected fraud, security risk, or to comply with law. On termination we may delete or anonymize Your Content after a reasonable retention period.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, or that AI output will be accurate.

12. Limitation of Liability

To the maximum extent permitted by law, form8n's aggregate liability arising out of or related to these Terms or the Service will not exceed the amount you paid to form8n in the twelve months preceding the claim, or USD $100, whichever is greater. form8n will not be liable for indirect, incidental, special, consequential, or punitive damages.

13. Indemnification

You agree to indemnify and hold harmless form8n from claims arising out of (a) Your Content, (b) your sales to buyers, (c) your violation of these Terms or applicable law.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in this section limits any non-waivable consumer rights in your country of residence.

15. Changes

We may update these Terms from time to time. Material changes will be announced via the Service or by email. Continued use after the effective date means you accept the updated Terms.
